摘要:
为剖析宗族与地方行政力量在土地产权实施过程中的互动特征，文章利用2014年CLDS数据，分析了宗族和行政力量对村庄地权实施的影响。在以民主选举表征民主治理的基础上，研究发现，宗族的存在会抑制土地法律文书的发放，并激励土地调整。在引入民主选举对宗族作用的调节效应后发现，在实施民主选举的村庄中，因传统惯习内嵌于基层治理，导致宗族对土地法律文书发放的抑制性增强。研究还发现，族权与行政权"合谋"会抑制土地法律文书的发放和土地调整，但民主选举会通过约束行政权和放活自治权，使二者的关系由行政权"绑架"族权变为宗族发挥自治功能。为避免行政权与族权"合谋"造成的治权资本化，并对非正式社会安排的自我实施功能加以合理利用，建议通过行政权让位自治权，政府治理扶持村民自治，治理单元多元化和自治功能下放等方式，发挥非正式社会安排在村庄地权保护中的积极作用。
Abstract:
In order to analyze the interaction characteristics of clan and administrative management in the village-level land tenure implementation, this paper employs households and village survey data collected by CLDS project in 2014 to empirically analyze the impact of clan and administrative power on land tenure implementation. Based on the democratic governance represented by democratic selection, the research results indicate that the clan negatively affects land documents issuing and positively affects land redistribution. This paper indicates that, in implementing village democratic selection, the clan has strengthened a negative impact on land documents issuing for grassroots governance embedded by traditional habits. Meanwhile, the combination of clan power and governance inhibit the land documents issuing and land redistribution, but through restricting administrative power and giving way to self-governance, the democratic governance can change the relationship between the two as to turn the clan power "kidnapped" by administrative power into self-governance by clans. This paper suggests that the positive role of informal social arrangement in village land tenure protection should be given play to through administrative power giving way to self-governance power, government supporting autonomy, governance diversification and decentralization, among other measures, to avoid the authority capitalization caused by the collusion of administrative power and the clan power and rationally use self-enforcing function of informal governance.
