摘要:
随着新型城镇化发展战略的实施和乡村社会经济的转型发展，现行农村宅基地制度的弊端日益凸显，制度变迁的"内卷化"提示了农村宅基地制度改革进一步深化的必然性。目前中国农村宅基地制度改革创新的关键在于还权赋能，着眼点在于走出宅基地保障维稳功能的惯性及财产功能限制性的"双重困境"，打破农民与农村宅基地之间的"脐带"关系，进一步细化和充实宅基地产权权能，将宅基地权能由目前的"两权"拓展为可以促进宅基地合理配置和节约利用、增加农民财产性收入及加快农民市民化和乡村振兴的"三权"，并按照落实宅基地集体所有权、保障宅基地农户资格权和放活宅基地使用权的思路推进农村宅基地制度改革创新。
Abstract:
With the implementation of the new urbanization development strategy and the transformation development of the rural social economy, the disadvantages of the current rural homestead system of China are becoming more and more prominent. The "involution" of institutional change prompts the inevitability of the rural homestead system reform. At present, the key to the rural homestead system reform in China is to go out of the "double dilemma", including the guarantee function inertia and the property function restrictive of the rural homestead, and breaking the "umbilical cord" relationship between the farmers and rural homestead. Using for the reference of the agricultural land "division of three rights", and based on the coordination perspective of peasant’s citizenship and rural revitalization, the paper puts forward the "division of three rights" idea of the rural homestead for promoting the reform and innovation of the rural homestead system, which includes implementing the property rights of rural homestead, guarantying the farmers’ qualification right of the rural homestead, and releasing the right of using rural homestead.
