摘要:
打破地类限制、创设综合地类、扩大入市范围、统筹推进集体经营性建设用地与宅基地入市,已成为现阶段农村土地改革的重要任务之一。在这一背景下,先后出现了湄潭县的"分割登记"模式、义乌市的"集地券"模式与佛山市南海区的"土地整备"模式等推进宅基地与集体经营性建设用地统筹入市的创新性改革模式。本文在"交易-关键交易属性-交易费用-治理结构选择"的分析框架下,选择区位条件、成本-收益不确定性、交易规模、交易主体数量、交易主体异质性和交易频率等六个关键交易属性,分析了上述三种入市模式各自的适用条件。研究结论表明,上述三种入市模式都是从自身的特定条件出发,为了最小化交易费用而选取的模式;各个入市模式本身并无优劣之分,只是其各自适用的条件有所不同。在深化农村土地制度改革的过程中,应保持足够的历史耐心,充分尊重基层的首创精神,鼓励地方因地制宜、因时制宜和因人制宜地探索符合自身实际情况的入市模式。
Abstract:
To break the restrictions on land types, create comprehensive land types, expand the market entry scope, and coordinate the advance of collectively-operated construction land and homestead has become one of the important tasks in the rural land reform at the present stage. In this context, there have been some innovative reform models to promote the integration of homestead and collective business construction land into the market, such as ‘divisional registration’ mode in Meitan County, ‘land voucher’ mode in Yiwu City, and ‘land preparation’ mode in Nanhai District. Based on the analysis framework of "Transaction-Key Transaction Attribute-Transaction Cost-Governance Structure Selection", this paper selects 6 key transaction attributes including location conditions, cost-benefit uncertainty, transaction scale, the number of transaction subjects, the heterogeneity of transaction subjects, and transaction frequency to analyze the respective applicable conditions of the above three market entry modes. The research results show that the above three modes are based on their own specific conditions and are selected to minimize transaction costs. There is no difference between the advantages and disadvantages of each mode, but their applicable conditions are different. In the process of deepening the reform of rural land system, we should maintain enough historical patience, fully respect the initiative of the grassroots, and encourage local governments to explore the market entry mode in line with their own actual conditions.
