摘要:
以“三权分置”地方实践和相关政策性文件为依据,厘析农民（农户）承包权权利属性的理论争议,揭示农民（农户）承包权的二元属性,或为成员权,或为物权,并证成“三权分置”有两类实现形式。以“三权分置”的政策目标要求和土地经营权功能定位为起点,论证土地经营权物权塑造的必要性,并从物权理论和立法技术两个方面,证成土地经营权物权塑造的可行性。在此基础上,结合制度演进的一般方法论、规范调整对象、制度可塑性以及制度变革必要性等因素,进一步揭示“三权分置”制度实现的路径依赖是立足于既存法制的适度制度创新。而适度创新的内容,则是解释论语境下的集体成员权细致化表达和立法论视域下的土地经营权物权塑造。
Abstract:
The theoretical controversies on the nature of contract rights of peasant households are discussed based on the local practices of tripartite entitlement system and relevant policies, and the contract rights of peasant households are found to have dual attributes-membership right or real rights-and the tripartite entitlement systems are found to have two forms of local practices. The necessity of land management rights as real right is demonstrated based on the request of relevant policies and the function of land management right,and the feasibility of land management rights as real right is shown from the angles of real right theories and legislative techniques. Furthermore, it is revealed that the path to the tripartite system depends on the innovation of the existing law, based on the general methodology, the standardization of readjusted objects, the flexibility of system and the necessity of system reform. The innovation of the existing laws embodies detailed expression of collective membership right under the context of explaining theories and the set-up of land management real right from the perspective of legislative theories.
